1. Agreement to Terms

By accessing or using the Klikk mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use our App.

These Terms apply to all users of the App, including but not limited to users who are browsers, vendors, customers, merchants, and/or contributors of content.

2. Use License

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App on your personal mobile device
• Access and use the App's features and services for personal, non-commercial purposes

2.2 Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose
• Attempt to circumvent usage limits or subscription tiers
• Use automated systems (bots, scripts) to access the App
• Resell, rent, lease, or sublicense the App to third parties

3. User Accounts

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem appropriate. You may also delete your account at any time through the App settings.

4. Subscription Required

4.1 Hard Paywall Model

Klikk is a paid-only application. There is no free tier. To use the app, you must subscribe to Klikk Pro.

4.2 Klikk Pro (Required)

All users must subscribe to Klikk Pro, which includes:

• Unlimited AI event recognition requests
• Batch image upload (up to 5 images at once)
• Calendar export to Apple Calendar, Google Calendar, or .ics format
• Priority customer support
• Early access to new features

Pricing: $9.95/month or $79.95/year (save 33%). Prices are subject to change with 30 days' notice.

4.3 Payment and Billing

iOS: All payments are processed through Apple In-App Purchase and charged to your Apple ID account.

Web/Android: All payments are processed securely through Stripe.

• Subscriptions auto-renew unless cancelled before the renewal date
• iOS: Manage subscriptions via Settings → App Store → Subscriptions
• Web: Manage subscriptions via klikk.li/account
• Refunds are handled according to Apple's or Stripe's refund policies (contact info@klikk.li)
• You are responsible for all taxes and fees associated with your subscription

4.4 Cancellation

You may cancel your subscription at any time:

• Your Pro access remains active until the end of the current billing period
• You cannot use the app after the subscription expires (no free tier)
• iOS: Cancel via Settings → App Store → Subscriptions
• Web: Cancel via klikk.li/account or in-app Settings
• No partial refunds are provided for unused time

5. AI Service and Accuracy

5.1 AI Recognition

Klikk uses AI-powered vision models (Qwen 2.5-VL 32B) to extract event information from images. While we strive for high accuracy:

• AI recognition is not 100% accurate
• Results depend on image quality, clarity, and content
• You are responsible for reviewing and verifying extracted information
• We are not liable for errors, omissions, or missed events

5.2 Service Availability

We do not guarantee uninterrupted availability of the AI service. The service may be temporarily unavailable due to maintenance, updates, or third-party API issues.

6. User Content

6.1 Your Content

You retain all rights to the images and content you upload to the App. By using the App, you grant us a limited license to:

• Process your images through our AI service for event extraction
• Store event data in our database
• Display your event history within the App

6.2 Prohibited Content

You may not upload content that:

• Is illegal, harmful, or violates third-party rights
• Contains malware, viruses, or malicious code
• Infringes on intellectual property rights
• Contains personal information of others without consent
• Is obscene, defamatory, or hateful

7. Intellectual Property

The App and its original content, features, and functionality are owned by Levin Fritz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, logos, and service marks ("Klikk" and the "K" logo) may not be used without our prior written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be error-free, secure, or uninterrupted
• Warranties regarding the accuracy or reliability of AI-extracted event information
• Warranties that defects will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LEVIN FRITZ, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, data, or use
• Business interruption
• Missed events or appointments due to AI errors
• Damages arising from use or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Levin Fritz and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the App
• Your violation of any third-party rights
• Content you upload to the App

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of St. Gallen, Switzerland.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last updated" date
• Sending an in-app notification or email

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement
